In a rare move, the Trump administration has filed a lawsuit against all federal judges in Maryland over a court order pausing deportations for two days. The Department of Justice alleges the order, issued by Chief Judge George Russell, unlawfully obstructs immigration enforcement by granting blanket delays for detainees filing habeas corpus petitions after hours.
The DOJ claims the pause amounts to a “preliminary injunction” without legal justification, calling it “judicial overreach” that undermines the Executive Branch’s authority. The administration has asked for all Maryland judges to recuse themselves and requested the case be reassigned to the 4th Circuit or an outside judge.
The court in Greenbelt has challenged federal immigration actions before. Judge Paula Xinis previously ordered the return of Kilmar Abrego Garcia after he was wrongfully deported to El Salvador. That case reached the U.S. Supreme Court, which upheld Xinis’ order.
Critics say the DOJ’s lawsuit signals a growing clash between Trump’s immigration agenda and judicial oversight in states resisting rapid deportation efforts.
