Homeland Security Secretary Kristi Noem repeatedly declined to confirm whether a photo used by President Donald Trump to label Kilmar Abrego Garcia an MS-13 gang member was doctored, during a tense House hearing on Wednesday.

Rep. Eric Swalwell (D-CA) pressed Noem about the image — which appears to have had “MS-13” digitally overlaid on existing tattoos — but she refused to directly engage. “I don’t have any knowledge as to that photo,” Noem said. She later added, “We will not be bringing him back.”

Swalwell presented a poster-sized version of the image, asking Noem to verify its authenticity. Noem refused to examine it closely, calling the exchange “a waste” of testimony time.

Abrego Garcia, deported to El Salvador earlier this year, had been granted legal protection in 2019 due to threats from rival gang Barrio 18. His lawyers argue he was wrongfully expelled and are fighting for his return, citing Trump’s use of the disputed photo in public statements.
