The U.S. Supreme Court has chosen not to hear a case concerning the rights of transgender students to use bathrooms that align with their gender identity. This decision leaves in place lower court rulings that favor transgender student rights.

The case involved Gavin Grimm, a transgender man who sued his Virginia school board in 2015 for barring him from using the boys’ restroom. The 4th Circuit Court of Appeals ruled twice that such policies are unconstitutional under the 14th Amendment and violate Title IX, which prohibits sex-based discrimination in education.

The Supreme Court’s choice not to intervene is seen as a significant victory for transgender student rights, amidst ongoing challenges by conservative states. This decision comes as the Department of Education’s June interpretation of Title IX now includes protections against discrimination based on sexual orientation and gender identity.
