A federal judge has denied former President Trump’s attempt to dismiss his Mar-a-Lago documents case. Trump argued that the over 300 classified records recovered from his property could be considered personal records. However, U.S. District Court Judge Aileen Cannon rejected this claim, stating that the Presidential Records Act does not provide a pre-trial basis for dismissal.

This ruling comes after special counsel Jack Smith urged the court to reject Trump’s claims. Smith called the idea that Trump could consider such records to be his personal property “pure fiction,” especially given that these highly classified documents were created by members of the intelligence community and military and presented to Trump during his term in office.

Trump is primarily being prosecuted under the Espionage Act, which prohibits the willful retention of national defense information. He is also charged with obstruction of justice for allegedly trying to conceal the records from authorities after they demanded their return.
