Attorneys for Donald Trump have requested that New York state Judge Juan Merchan postpone sentencing and set aside the trial verdict in Trump’s hush money case after the Supreme Court’s presidential immunity ruling on Monday.
Trump’s lawyers want to brief the judge on the high court’s decision, arguing it confirmed that the Manhattan district attorney should not have offered evidence at trial concerning Trump’s official presidential acts.
The attorneys aim to throw out Trump’s conviction on 34 felony counts of falsifying business records and delay next week’s sentencing, according to sources. Trump pleaded not guilty to charges related to a hush money payment by his former attorney Michael Cohen to adult film star Stormy Daniels during the 2016 presidential campaign.
The Supreme Court ruling limits evidence that can be used at trial. Many actions presented in the hush money trial occurred before Trump took office in 2017. Post-office actions included checks Trump signed from his personal account and records prepared by his business, as well as a White House meeting with Cohen.
The district attorney’s office declined to comment. The Supreme Court ruled 6-3 to reject Trump’s broad claim of immunity in his federal election interference case, delaying that trial until after Election Day.
