Donald Trump’s legal team will request a trial postponement or dismissal, arguing that the late provision of significant evidence from prosecutors hampers their defense. This evidence pertains to Michael Cohen, Trump’s former lawyer, involved in a $130,000 payment to adult film actress Stormy Daniels to prevent her from discussing a claimed sexual encounter with Trump, which he denies.
The defense criticizes the Manhattan District Attorney for introducing thousands of pages of documents related to Cohen only weeks before the trial, alleging an attempt to obscure evidence that could discredit Cohen’s testimony. The initial investigation by the U.S. Attorney’s office in Manhattan did not charge Trump, though Cohen was convicted for campaign finance violations linked to the payment, claiming Trump directed him.
With the trial initially set for Monday, prosecutors agreed to a 30-day extension for document review. However, Trump’s team is pushing for further delay or case dismissal, citing the untimely evidence disclosure.
This trial marks one of several legal challenges Trump faces, including a significant civil fraud judgment and other criminal cases related to the 2020 election and handling of sensitive documents. Amid these legal battles, Trump, pledging to run against Biden in the next election, has denounced the case as a “witch hunt” and utilized it for fundraising, while his attorneys argue the payment was personal, not campaign-related.
Prosecutors counter that no additional delay is warranted, emphasizing the duplication or irrelevance of most new documents to Trump’s defense.
