Donald Trump is seeking to postpone his March 25 hush money trial until the Supreme Court addresses his presidential immunity claims from another criminal case. His lawyers have requested Manhattan Judge Juan Manuel Merchan to delay the New York trial until Trump’s immunity argument in his Washington, D.C., election interference case is resolved. The Supreme Court is set to hear arguments on April 25, following the start of Trump’s hush money case, which is the first of four criminal cases he faces.
In the hush money case, Trump is accused of falsifying records to conceal payments made to his former lawyer Michael Cohen for burying negative stories during his 2016 campaign, including a payment to Stormy Daniels regarding an alleged extramarital affair, which Trump denies. Trump has pleaded not guilty to 34 felony counts of falsifying business records, asserting the payments were legitimate legal expenses.
A federal judge previously rejected Trump’s claim that the allegations involved official duties, emphasizing that hush money payments are not related to presidential acts. This ruling was upheld despite Trump’s appeal, which was later dropped. The legal question of a former president’s immunity from prosecution for actions taken in office remains untested, with lower courts ruling against Trump but the Supreme Court agreeing to reconsider the issue, adding uncertainty to the timing of the trial.
