The Trump administration on Wednesday asked the Supreme Court to block lower court orders requiring the Department of Government Efficiency (DOGE), led by Elon Musk’s appointee Amy Gleason, to release internal documents to a government watchdog group. The case centers on whether DOGE is subject to the Freedom of Information Act (FOIA).

The watchdog group Citizens for Responsibility and Ethics in Washington (CREW) sued earlier this year, arguing DOGE wields vast power, including shuttering USAID and canceling billions in federal contracts, without public oversight.

U.S. District Judge Christopher Cooper ruled that DOGE appears to exercise independent authority beyond a mere advisory role and ordered the agency to comply with document requests and depositions by June 13. The administration maintains DOGE is exempt from FOIA, calling the order “extraordinarily overbroad.”

Solicitor General D. John Sauer filed the emergency appeal. The case joins a growing list of Trump administration policies facing Supreme Court review following setbacks in lower courts.
