A federal appeals court ruled Saturday that the Trump administration cannot deploy National Guard troops in Illinois but may keep them under federal control as court challenges continue. The Chicago-based U.S. Court of Appeals for the 7th Circuit upheld part of a lower court’s decision blocking deployment to the Chicago area, citing risks of “civil unrest.”

President Donald Trump had ordered around 500 Guard members from Illinois and Texas to be activated near Chicago to “protect federal officers and assets” following protests outside an ICE facility in Broadview, Illinois. U.S. District Judge April Perry, a Biden appointee, issued a 14-day restraining order halting the deployment, writing the move would “only add fuel to the fire.”

Illinois Gov. JB Pritzker (D) condemned the plan, calling it “a grave intrusion on state sovereignty.” The appeals court ruling allows federal control of the troops to remain in place but prohibits deployment unless a new order is issued. Another hearing is scheduled before the injunction expires on October 23.
