Former President Trump has pledged to reverse transgender student protections introduced by the Biden administration if he wins the next election. The Education Department recently made changes to Title IX, a federal civil rights law, to include discrimination based on sexual orientation and gender identity. Trump, during a radio show appearance, promised to end these changes on his first day back in office.
Biden’s 2021 executive order ensured an educational environment free from sex discrimination, including sexual orientation or gender identity. Trump has also promised to implement policies targeting transgender rights, including a nationwide ban on transgender student-athletes competing in line with their gender identity.
Title IX enforcement varies with each administration, and Republican governors and education officials have vowed to reject the expanded protections for transgender students. Lawsuits filed by Republican-led states allege the new rule undermines federal nondiscrimination protections for non-transgender students. These lawsuits are expected to temporarily block the new Title IX regulations. The Biden administration is yet to finalize a separate rule governing athletics eligibility.
