In an Associated Press interview, President Donald Trump declined to say whether due process protections should apply equally to U.S. citizens and noncitizens, sparking renewed concerns over constitutional rights.

Asked whether the Fifth Amendment’s due process clause applies to all individuals, Trump responded, “I don’t know. I’m not a lawyer.” He added that his legal team “will obviously follow what the Supreme Court said,” referencing the court’s order requiring the U.S. to facilitate the return of Kilmar Abrego Garcia, a Salvadoran man mistakenly deported from Maryland.

Trump claimed Abrego Garcia was a member of MS-13 and used the case to highlight his push for stricter immigration enforcement: “I was elected to get them the hell out of here, and the courts are holding me from doing it.”

The Fifth and 14th Amendments guarantee due process and equal protection for all persons, not just citizens. Critics argue Trump’s stance undermines those constitutional protections.
