President Donald Trump has asked a federal appeals court to overturn his New York hush money conviction, citing the Supreme Court’s presidential immunity ruling as grounds to invalidate the verdict. Trump’s lawyers argue that prosecutors should have been barred from using any evidence related to his official presidential acts, which they claim tainted the case.

The filing also requests that the state criminal case be transferred to federal court, a move that could position it for eventual Supreme Court review, where Trump has seen favorable rulings on immunity-related matters.

Trump was convicted in May 2024 on 34 felony counts of falsifying business records tied to payments to adult film actress Stormy Daniels. His attorneys contend the conviction should be voided due to judicial and procedural errors, including jury instructions by Judge Juan Merchan that allegedly violated due process.

They also argue that prosecutors under Manhattan District Attorney Alvin Bragg failed to specify the underlying “second crime” behind the falsified records charge. The jury, they claim, was allowed to convict without unanimous agreement on which unlawful act Trump had conspired to commit — a violation of both due process and New York election law.
