President Donald Trump once again referred to Elon Musk as the leader of the Department of Government Efficiency (DOGE) during his joint address to Congress, despite White House and Justice Department claims that Musk does not run the agency.
“I have created the brand-new Department of Government Efficiency, DOGE, perhaps you’ve heard of it, which is headed by Elon Musk,” Trump said Tuesday night, as Musk sat in the gallery.
Trump’s repeated claims have intensified legal scrutiny, with multiple lawsuits arguing that DOGE violates federal transparency laws. Plaintiffs challenging DOGE’s constitutionality immediately cited Trump’s speech in new court filings, arguing that Musk acts as a de facto government official without a formal appointment under the Appointments Clause.
The White House previously insisted that Amy Gleason is DOGE’s acting administrator, yet Musk continues to publicly take credit for its actions. The Justice Department has struggled to clarify DOGE’s leadership, adding to legal uncertainty over the agency’s structure.
