The Supreme Court will hear arguments on May 15 regarding the Trump administration’s plan to limit birthright citizenship. The administration’s policy seeks to deny automatic U.S. citizenship to children born in the country to undocumented immigrants.
Multiple federal courts have blocked the executive order, ruling it likely violates the 14th Amendment’s citizenship clause, which guarantees citizenship to “all persons born or naturalized in the United States.” The administration contends the clause was never meant to cover children of those in the U.S. illegally.
If upheld, the policy would overturn long-standing legal precedent on citizenship rights. The Supreme Court’s decision to take the case marks a significant test of the 14th Amendment’s scope.
Several states have asked the court to reject the Trump administration’s interpretation, while the administration maintains the change is necessary to address what it describes as abuse of immigration laws.
