The Supreme Court upheld a law requiring TikTok’s China-based parent company, ByteDance, to divest from the app, setting the stage for a ban starting Sunday. With President-elect Donald Trump’s inauguration days away, the decision leaves the ban’s enforcement to his administration.
White House Press Secretary Karine Jean-Pierre stated Friday that implementing the law would be left to the incoming administration. President Biden supported the bipartisan legislation, emphasizing TikTok should remain available under non-Chinese ownership to address national security concerns.
Trump told CNN the decision “ultimately goes up to me” but has not revealed his plans. Despite past criticisms of TikTok, Trump has recently softened his stance, with TikTok CEO Shou Zi Chew slated to attend his inauguration.
The Supreme Court unanimously rejected TikTok’s argument that divestment was unfeasible, effectively upholding the law and leaving the app’s future uncertain.
