The Supreme Court ruled Monday that former President Donald Trump has immunity from criminal prosecution for some actions taken while fighting to overturn the 2020 election. This decision complicates special counsel Jack Smith’s efforts to try Trump on charges of fraud.

The ruling, which split the court ideologically, dismissed central allegations that Trump tried to weaponize the Justice Department to support false voter fraud claims. However, the case returns to U.S. District Judge Tanya Chutkan, who must now distinguish between Trump’s official presidential acts and his actions as a candidate. This process could delay the trial beyond Election Day.

Chief Justice John Roberts stated that former presidents have “absolute” immunity for actions within their “core constitutional powers” but clarified that this does not extend to “unofficial acts.”
