The Supreme Court rejected Robert F. Kennedy Jr.’s request to be removed from the presidential ballots in Michigan and Wisconsin after his recent endorsement of former President Donald Trump. Kennedy argued that keeping his name on ballots in key swing states could pull votes from Trump and amounted to “compelled speech,” a First Amendment violation. In a brief dissent for Michigan, Justice Neil Gorsuch sided with Kennedy but did not dissent in the Wisconsin case.
State attorneys argued against removing Kennedy’s name, noting that voting has already begun and that such a change was unfeasible. Michigan’s Secretary of State and Wisconsin’s Department of Justice argued that Kennedy’s request was both impractical and lacked merit.
