The Republican National Committee (RNC) has sued Nevada to stop counting mail ballots received post-Election Day, challenging a state law passed in 2021. The law allows mail ballots to be counted up to four days after Election Day if postmarked on time. The RNC argues this violates the U.S. Constitution’s single Election Day requirement.
RNC Chairman Michael Whatley stated, “Nevada’s ballot receipt deadline clearly violates federal law and undermines election integrity in the state. Ballots received days after Election Day should not be counted.”
This lawsuit is part of a larger trend, with the RNC filing 83 election-related suits six months before Election Day, indicating a focus on election rules. Nineteen states, including Nevada, allow post-Election Day ballot tallying.
Nevada’s Democratic Secretary of State, Francisco Aguilar, responded, “I hope the RNC is putting as much time and energy into educating voters on how to participate in elections as they put into suing the state of Nevada.”
