Independent presidential candidate Robert F. Kennedy Jr. will not appear on New York’s presidential ballot in November, after a state judge ruled Monday that he falsely claimed residency in the state. Judge Christina Ryba determined that the room Kennedy used to claim residency in the New York City suburbs was not a “bona fide and legitimate residence,” but rather a “sham” address.

The challenge was filed by Clear Choice Action, a Democratic-aligned group targeting Kennedy and other third-party candidates’ ballot access nationwide. Ryba highlighted that photos of Kennedy’s supposed residence showed it was not suitable for a full-time residence. The judge noted Kennedy’s history of using friends’ addresses to maintain New York voter registration while residing in California.

Kennedy’s campaign denounced the ruling and plans to appeal, blaming Democrats for trying to limit voter choices. If upheld, the decision could prompt similar challenges across the country.
