In advance of the 2030 census, Republicans have introduced a series of bills to exclude noncitizens from the U.S. apportionment count used to determine House seats and Electoral College votes. The 14th Amendment currently mandates counting the “whole number of persons” in each state.

One bill from the House Appropriations Committee would bar the Census Bureau from including undocumented immigrants. Additional legislation from Sen. Bill Hagerty and Rep. Chuck Edwards aims to exclude all noncitizens, including visa and green card holders. These proposals would require census forms to ask about citizenship and immigration status—an untested move that could affect count accuracy.

Marjorie Taylor Greene has proposed an even broader plan to conduct a new census and reapportionment before 2030. Legal experts expect lawsuits, recalling the Donald Trump administration’s failed attempt to add a citizenship question in 2020.

A constitutional amendment reintroduced by Rep. Warren Davidson would allow only citizens to be included in apportionment—but would require two-thirds of Congress and approval by three-fourths of states to succeed.
