Rep. Joe Morelle (D-N.Y.) announced plans to introduce a constitutional amendment to reverse a Supreme Court ruling that shields former presidents from criminal prosecution for actions taken in office. “I will introduce a constitutional amendment to reverse SCOTUS’ harmful decision and ensure that no president is above the law,” Morelle wrote on X (formerly Twitter).

The Supreme Court’s 6-3 decision, along ideological lines, grants presidents absolute immunity for actions within their core responsibilities and presumptive immunity for other official acts. This ruling benefits former President Trump in his federal election subversion case, sending it back to a lower court to determine if his Jan. 6 actions are protected.

A Supreme Court ruling on a constitutional issue is nearly final, changeable only by a constitutional amendment or a new ruling. Morelle and other Democrats argue that no one, including the president, should be above the law. The ruling, they say, contradicts the Constitution’s intent.

Justice Sonia Sotomayor, in her dissent joined by two other liberal justices, stated, “In every use of official power, the President is now a king above the law.”
