Planned Parenthood filed a federal lawsuit Monday challenging a provision in Donald Trump‘s newly signed tax and spending law that bars Medicaid payments to health centers providing abortions. Filed in U.S. District Court in Massachusetts, the suit claims the law unconstitutionally strips patients of their right to use Medicaid at any Planned Parenthood clinic.
The organization alleges the law “specifically targets” Planned Parenthood for legal abortion advocacy and care, despite long-standing federal rules prohibiting the use of Medicaid for abortion services. The law imposes a one-year ban on Medicaid funding for nonprofits offering abortions and receiving over $800,000 in federal funds in 2023 — a standard that primarily affects Planned Parenthood.
Roughly 200 clinics in 24 states, mostly in states where abortion is legal, are at risk of closing. Planned Parenthood CEO Alexis McGill Johnson emphasized the suit’s focus: ensuring patients retain access to essential services like birth control and cancer screenings.
The Department of Health and Human Services declined to comment on the case.
