A county judge in Ohio, David C. Young, temporarily blocked several state laws on Friday that imposed a 24-hour waiting period and other restrictions on abortion. This decision marks the first judicial ruling on a 2023 constitutional amendment that guarantees access to abortion in the state.
Judge Young ruled that the language of the amendment, passed as Issue 1, was “clear and unambiguous,” and found that the challenged statutes unduly burdened the right to abortion. The blocked rules included requirements for an in-person visit, a 24-hour waiting period, and mandatory information provision. Young stated these laws did not advance patient health.
Republican Attorney General Dave Yost announced plans to appeal, arguing that such requirements were upheld under Roe v. Wade. Yost’s office maintained that informed consent and waiting periods are essential safety measures.
The ACLU of Ohio celebrated the ruling as a “historic victory,” with attorney Jessie Hill affirming their intent to seek a permanent injunction.
