An Ohio judge ruled Thursday to permanently block the state’s “heartbeat law,” which banned most abortions after six weeks. Judge Christian Jenkins stated that Ohio’s new reproductive rights amendment, passed last year, makes the 2019 law unconstitutional. The law had been paused since its introduction, awaiting a legal challenge by the ACLU, Planned Parenthood, and other groups.
Judge Jenkins criticized Attorney General Dave Yost’s attempt to retain portions of the law, saying it contradicts the Supreme Court’s move to give states authority over abortion. “The State of Ohio seeks not to uphold… but to diminish and limit it,” Jenkins wrote, emphasizing that his decision reflects voters’ intentions.
The ruling came after the Dobbs decision overturned Roe v. Wade, prompting states to address abortion rights locally. Ohio’s Issue 1, the new amendment, enshrines residents’ rights to make personal reproductive choices. Yost’s office is reviewing the ruling and may appeal.
