In a legal setback, a New York appeals court upheld a gag order against former President Donald Trump amidst his ongoing hush money trial. The court’s decision came as Trump appeared in court on Tuesday.
The Legal Battle
Trump’s legal woes continue as he stands trial for allegedly falsifying business records to conceal a payment to adult film actor Stormy Daniels during the 2016 presidential campaign. Manhattan District Attorney Alvin Bragg asserts that the payment was a strategic move to silence Daniels about her claimed affair with Trump, an allegation Trump vehemently denies.
Court’s Ruling
The appeals court supported Judge Juan Merchan’s decision to impose the gag order, stating, “Justice Merchan properly determined that petitioner’s public statements posed a significant threat to the integrity of the testimony of witnesses and potential witnesses in this case as well.” This ruling is the latest in a series of defeats for Trump, who has been contesting the gag order.
Gag Order Details
The gag order restricts Trump from publicly discussing the witnesses, the judge’s or district attorney’s staff and family, or prospective jurors. However, it permits Trump to express his views on Bragg and Merchan. The judge has warned Trump of potential jail time for any social media activity breaching the order.
Trump’s Response
Trump has pleaded not guilty to all charges and maintains that the prosecution is politically motivated. His legal team’s appeal of the gag order was denied, solidifying the restrictions on his public commentary as the trial progresses.
