Judge Aileen Cannon dismissed former President Trump’s case over alleged mishandling of classified information, ruling that special counsel Jack Smith was unlawfully appointed. This marks the first dismissal among Trump’s four criminal cases.
“The Superseding Indictment is dismissed because Special Counsel Smith’s appointment violates the Appointments Clause of the United States Constitution,” Cannon wrote in a 93-page ruling. She clarified that her decision is “confined to this proceeding.”
This ruling comes just days after an attempted assassination against the former president.
