A federal judge in Kentucky ruled Thursday that the Biden administration’s updates to Title IX, aimed at expanding protections for LGBTQ students, are unconstitutional. The changes, unveiled in April, broadened the definition of sex discrimination to include gender identity and sexuality and allowed transgender students to use facilities aligning with their gender identity.
Judge Danny C. Reeves, appointed by President George W. Bush, ruled the provisions overstepped the Education Department’s authority and were inconsistent with Title IX’s original intent. He cited concerns about free speech, arguing the rule could classify misgendering as harassment.
The lawsuit, led by six GOP-led states, claimed the regulations undermined protections for women. Conservative leaders, including President-elect Trump, criticized the rules for potentially allowing transgender athletes in women’s sports. LGBTQ advocacy groups denounced the decision, warning it endangers vulnerable students and undermines inclusivity in schools.
