On Tuesday, Judge Aileen Cannon indicated she is unlikely to grant Donald Trump’s request to exclude evidence in his classified documents case. During a federal court hearing in Florida, Cannon questioned Trump’s lawyers’ argument that the FBI overstepped in its search of Mar-a-Lago, which uncovered numerous boxes of national security documents.
Cannon, a Trump appointee, expressed doubts about the claim that FBI agents might not have obtained a search warrant if they had consulted Trump’s lawyers. “Why would that have mattered legally?” she asked. Trump’s legal team argued the search violated the Constitution by allowing overly broad authority. Prosecutors defended the search as necessary, revealing it followed Trump’s alleged obstruction of a legal demand to return the documents.
Trump faces charges of illegally retaining classified documents after leaving office in 2021, to which he has pleaded not guilty. The judge also reviewed a request to quash evidence from Trump’s former attorney, Evan Corcoran, who had been compelled to testify. Cannon’s decision on the motions remains pending.
