A Wisconsin judge on Saturday declined to stop billionaire Elon Musk from distributing $1 million checks to two voters at a Sunday rally ahead of the state’s high-stakes Supreme Court election. State Attorney General Josh Kaul immediately appealed the ruling.

Kaul argued Musk’s plan violates state election law, which prohibits giving anything of value in exchange for voting. Columbia County Circuit Judge Andrew Voigt refused to grant an emergency injunction, prompting Kaul to file an appeal with the state Court of Appeals.

Musk, who supports conservative candidate Brad Schimel, said he would award $1 million each to two Wisconsin residents for signing an online petition opposing “activist” judges. He also pledged $100 to others who signed. Musk’s political action committee has spent over $20 million on the race.

The election will determine control of the state’s Supreme Court, which currently has a 4-3 liberal majority. A retirement has put that majority at stake, with the election concluding Tuesday.
