A federal judge granted Hunter Biden’s request to delay his tax trial, which was set to start next month in California. U.S. District Judge Mark C. Scarsi approved moving the trial from June 20 to September 5. Last month, Scarsi denied Biden’s motion to dismiss counts from the indictment, which alleges Biden failed to pay taxes, failed to file, evaded assessment, and filed a fraudulent form.

Biden’s attorney, Abbe Lowell, argued that they needed more time to prepare, as Biden faces a separate gun charges trial in Delaware starting June 3. Lowell expressed concerns that the gun trial might extend longer than expected, leaving insufficient time to prepare for the tax case. Lowell also cited difficulties in securing defense experts due to the high-profile nature of the case.

Special counsel prosecutor Leo Wise opposed the delay, noting that 30 witnesses had scheduled for the June trial. Wise criticized the defense’s difficulty in finding experts, asserting that experts are readily available. He described both Biden trials as “simple cases,” estimating the tax trial would take six days.

Despite his initial reluctance, Judge Scarsi agreed to the delay after Lowell explained the need for additional preparation time, family vacation, and an unrelated court argument. Scarsi set a firm trial date of September 5.

A federal appeals court recently denied Biden’s request to postpone the gun charges trial, which relates to possession of a gun while using narcotics. Biden has pleaded not guilty in both cases.

Lowell did not immediately respond to requests for comment, and Weiss’ office declined to comment.
