U.S. District Judge Tanya Chutkan on Tuesday rejected a request by 14 Democratic-led states to immediately block Elon Musk’s Department of Government Efficiency (DOGE) from accessing seven federal agencies. The states, led by New Mexico, argue that Musk’s role in DOGE is unconstitutional since he was not confirmed by the Senate.

Chutkan ruled that the plaintiffs had not demonstrated the necessary level of “irreparable harm” to justify a temporary restraining order. However, she acknowledged concerns over DOGE’s authority, stating that Musk appears to wield “unchecked authority” over an entity created without congressional oversight.

The ruling comes amid growing legal challenges to DOGE’s efforts to restructure government agencies. The Justice Department maintains that Musk is only a Senior Advisor to the President and lacks formal decision-making power. However, Chutkan questioned that assertion, noting the administration’s sweeping personnel actions across federal agencies.

Multiple lawsuits remain pending against DOGE as concerns grow over its authority and access to government data.
