A federal judge has temporarily blocked the Trump administration from arresting or deporting 21-year-old Columbia University student Yunseo Chung, a legal permanent U.S. resident originally from South Korea.
U.S. Immigration and Customs Enforcement (ICE) began pursuing Chung shortly after her March 5 arrest at a pro-Palestinian protest. Her attorneys argue ICE is targeting her for protected political speech, referencing the earlier arrest of Mahmoud Khalil, another pro-Palestinian student activist.
On Tuesday, Judge Naomi Reice Buchwald granted a temporary restraining order barring Chung’s detention or removal. She warned the administration must notify the court if it pursues her detention on any grounds, to ensure it isn’t pretextual retaliation for First Amendment activity.
The lawsuit, filed by the Lawyers’ Committee for Civil Rights, alleges the administration is using immigration enforcement to suppress dissent. The Department of Homeland Security confirmed Chung is being sought for removal, citing “concerning conduct” and describing the protest as “pro-Hamas.”
Chung’s legal team says officials are attempting to revoke her green card using a rarely invoked statute tied to foreign policy threats.
