President Joe Biden plans to endorse Supreme Court reforms, including an enforceable ethics code and term limits for justices, following recent controversial decisions and ethics scandals. Currently, Supreme Court appointments are for life. A Hart Research survey showed that 64% of voters support term limits, including 78% of Democrats and 51% of Republicans. Similarly, an Associated Press-NORC poll found 67% of Americans favor term limits.
Despite broad public support, Biden does not plan to pursue court packing, a measure some progressives favor to balance the court’s conservative majority. Legal analysts are divided on the feasibility of Biden’s plans. Elie Mystal argued that without expanding the court, term limits and ethics codes might fail, while law professor Anthony Michael Kreis suggested term limits could be established by statute but doubted the court would easily accept such changes.
A group of Democratic senators has introduced a bill for 18-year term limits, with justices handling limited cases afterward. Congressional support remains uncertain.
