House Minority Leader Hakeem Jeffries (D-NY) is calling on the judiciary — including the Supreme Court — to enforce its order requiring the Trump administration to return a Maryland man mistakenly deported to El Salvador.

Kilmar Abrego-Garcia, a Salvadoran national with legal U.S. work authorization, was deported despite a 2019 court ruling barring his removal due to threats he faced in El Salvador. In an interview on MSNBC, Jeffries said the courts must consider holding administration officials — including the secretaries of State and Homeland Security — in contempt to enforce the order.

The Trump administration has refused to facilitate Abrego-Garcia’s return, claiming no legal obligation to retrieve him. Salvadoran President Nayib Bukele also declined to release the man during a White House visit Monday, despite a Supreme Court ruling stating the deportation was improper.

Legal scholars note that contempt rulings against executive officials are historically rare and carry significant constitutional risks, potentially setting off an unprecedented crisis between branches of government.
