Hunter Biden’s attorneys filed nine motions to dismiss tax-related charges brought by special counsel David Weiss in a California federal court, alleging selective and vindictive prosecution. The legal team, led by attorney Abbe Lowell, argued that charges were pursued under undue political pressure, with violations of previously binding agreements, and claimed that the statute of limitations for some charges had expired. They also highlighted issues with duplicative charges, improper venue, and contested the legitimacy of Weiss’s appointment as Special Counsel due to alleged Congressional funding approval lapses.

In defense, the filings pointed out that Hunter Biden had settled a tax charge from 2019 by paying the owed taxes with interest and penalties, a situation they argue typically precludes criminal charges. Additionally, the defense criticized the influence of IRS whistleblowers Gary Shapley and Joseph Ziegler, accusing them of biasing the prosecution through “unprecedented leaks.”

The motions further contended that the indictment included “inflammatory characterizations and gratuitous facts” potentially prejudicial to a fair trial. Hunter Biden, who pleaded not guilty to the nine tax-related charges in January, has faced scrutiny for alleged financial mismanagement instead of tax payments, with his legal team previously seeking dismissal of gun-related charges in Delaware on similar grounds of prosecutorial overreach.
