Hunter Biden has agreed to drop his civil lawsuit against Rudy Giuliani and Giuliani’s former lawyer, Robert Costello, according to a court filing on Thursday. Last year, Biden accused Giuliani and Costello of violating computer fraud and data access laws, alleging manipulation of data from his devices.

The agreement, filed by attorneys for all parties, states that Biden will drop the lawsuit and each party will cover their own legal fees. The suit initially sought over $75,000 in damages, attorneys’ fees, and other penalties.

A source familiar with the filing explained that since Giuliani is in bankruptcy, it made sense to pause the case in non-bankruptcy court. Giuliani sought bankruptcy protection in December after a $148 million defamation verdict.

Biden’s lawsuit, filed in September, claimed Giuliani, his businesses, Costello, and others were responsible for the “total annihilation” of Biden’s digital privacy, alleging extensive tampering with his digital data. Giuliani’s adviser, Ted Goodman, countered that Biden previously denied ownership of the laptop, now claiming it was manipulated.

The lawsuit was originally filed in the Central District of California and later moved to the Southern District of New York. Costello, who previously represented Giuliani, sued Giuliani for $1.36 million in unpaid legal fees.

The filing comes shortly after Biden was found guilty on three federal gun-related charges and ahead of his September trial on separate tax-related charges.
