House Speaker Mike Johnson (R-LA) announced a policy restricting access to single-sex bathrooms and locker rooms in the Capitol and House office buildings based on biological sex. He stated the measure ensures “single-sex facilities… are reserved for individuals of that biological sex.” Private member restrooms and unisex facilities remain available.

The policy follows Rep. Nancy Mace’s (R-SC) resolution aimed at Rep.-elect Sarah McBride (D-DE), the first transgender member of Congress, barring McBride from using female-designated bathrooms.

Enforced by the House sergeant-at-arms, details on penalties for violations are unclear. Johnson noted the policy was previously unwritten but is now formalized. Historical enforcement examples, like fines for bypassing metal detectors after Jan. 6, 2021, suggest potential penalties.
