Republicans and conservative activists are increasingly targeting a 2021 executive order by President Biden aimed at boosting voter registration, claiming it’s unconstitutional and an attempt to influence the upcoming election. A GOP political action committee described the order as making federal agencies act as Biden’s personal “Get-Out-The-Vote” machine. A Republican-led House committee issued subpoenas to agency directors, and GOP secretaries of state have asked the Supreme Court to review the order.

Despite these claims, there’s no evidence that the order favors one party. White House spokesperson Robyn Patterson defended the order, saying it protects voting rights for all eligible citizens. Biden issued the order as Republican legislatures were passing state voting restrictions based on false fraud claims from the 2020 election.

The order directs federal agencies to facilitate voter registration and ensure voting information is accessible. Republicans argue this exceeds federal authority and have criticized the use of federal programs like SNAP for voter registration efforts. Agencies have complied with state requests, with some states designating federal offices as voter registration agencies.

The Supreme Court has not yet decided whether to take up the case, with any arguments unlikely before next year. Critics, like David Becker of the Center for Election Innovation & Research, argue the order supports voter registration and election integrity.
