Republicans filed a request with the U.S. Supreme Court on Monday, seeking an emergency intervention to halt Pennsylvania’s counting of provisional ballots cast by voters whose mail-in ballots were rejected due to procedural errors, like missing secrecy envelopes. This action comes just days before the election in this key swing state.

The Pennsylvania Supreme Court previously ruled 4-3 in favor of counting these provisional ballots. State and national Republicans, however, argue that state law does not allow voters to “fix” mail-in ballot mistakes by casting a provisional ballot. If the Supreme Court does not fully halt the ruling, Republicans seek an order to keep these ballots separate from the official vote count until the legal dispute is settled.

This Pennsylvania case joins another election-related issue from Virginia, where state officials are asking the Supreme Court to address voter registration purges. Voting rules, particularly regarding mail-in ballots, became a frequent topic of legal battles starting in 2019, when Pennsylvania significantly expanded mail voting.
