A judge in Georgia has overturned the state’s six-week abortion ban, reinstating legal access to abortions before this period. Fulton County Superior Court Judge Robert McBurney ruled that the ban violated the constitutional rights of women to make decisions about their healthcare. McBurney emphasized that liberty in Georgia includes the right for a woman to control her body and reject state interference in her healthcare choices. He stated the ban was “inconsistent” with the rights of mothers, deeming it unconstitutional.
The ruling blocks Georgia from enforcing the six-week restriction. The ban, originally enacted in 2019, took effect after the 2022 U.S. Supreme Court decision overturning Roe v. Wade. A September 2024 report by ProPublica revealed that the new abortion rules contributed to the deaths of at least two women in Georgia, including one who avoided medical care out of fear of legal repercussions.
