Free speech organizations, including the ACLU, Electronic Frontier Foundation, and Knight First Amendment Institute, are urging a federal appellate court to reject Elon Musk’s attempt to revive a lawsuit against the nonprofit Center for Countering Digital Hate (CCDH). The lawsuit stems from CCDH reports highlighting offensive posts on X Corp. (formerly Twitter), alleging the platform failed to remove racist and antisemitic content.
Musk’s X sued CCDH, claiming the nonprofit breached its terms of service by “scraping” data and violated anti-hacking laws. However, U.S. District Judge Charles Breyer dismissed the case under California’s anti-SLAPP law, stating the lawsuit was about punishing the nonprofit for its speech. X has appealed, arguing its claims relate to “data security,” not free speech. Free speech advocates argue X is misusing contract and anti-hacking laws to suppress criticism.
