Cuomo defended the state’s controversial March 2020 advisory, which barred nursing homes from rejecting COVID-19 positive patients, by citing three Department of Justice investigations that found no fault in New York’s actions. He emphasized that New York adhered to guidance from the Centers for Medicare and Medicaid Services (CMS) and the Centers for Disease Control and Prevention (CDC).
Republicans grilled Cuomo over the policy, alleging it led to unnecessary deaths. Cuomo countered, calling the criticism political and pointing out that similar directives in Republican-led states were not investigated. He argued that the criticism was part of a broader political attack on blue states.
Republican Representatives Claudia Tenney and Elise Stefanik of New York publicly criticized Cuomo ahead of his testimony.
