A federal judge in Seattle issued a nationwide temporary restraining order blocking former President Donald Trump’s executive order to limit birthright citizenship. U.S. District Judge John Coughenour, a Reagan appointee, deemed the order “blatantly unconstitutional,” rejecting the claim that children of undocumented immigrants are excluded from the 14th Amendment’s citizenship guarantee.
“This attempt to redefine the 14th Amendment is a modern version of Dred Scott,” Coughenour stated.
The lawsuit, led by Washington Attorney General Nick Brown and joined by Oregon, Illinois, and Arizona, argued the order could deny citizenship to 150,000 newborns annually. Brown called the order “an unconstitutional attempt to redefine what it means to be an American.”
The Trump administration argued that such children are not under U.S. jurisdiction, but Coughenour dismissed this, affirming the amendment’s protections. The case is expected to head to the Supreme Court.
