A federal appeals court ruled Thursday that the U.S. government’s ban on licensed firearms dealers selling handguns to adults aged 18 to 20 is unconstitutional. The Louisiana-based 5th Circuit Court of Appeals found the restriction lacked historical precedent, citing the Supreme Court’s 2022 Bruen decision.
Judge Edith Jones, writing for the panel, stated that the Second Amendment protects young adults’ right to bear arms and that the government provided little evidence of similar age-based bans at the nation’s founding. The ruling overturns a previous 5th Circuit decision upholding the 1968 restriction.
The Firearms Policy Coalition praised the ruling as a major win for gun rights. The Justice Department has not said whether it will appeal. The decision currently affects Louisiana, Mississippi, and Texas.
