A lawsuit will be filed against President-elect Donald Trump’s Department of Government Efficiency (DOGE) immediately after his inauguration. The plaintiffs, represented by the public interest law firm National Security Counselors, allege DOGE, co-led by Elon Musk, violates the Federal Advisory Committee Act (FACA), which mandates public meetings and transparency for federal advisory committees.
Executive Director Kel McClanahan stated, “DOGE is not exempted from FACA’s requirements,” emphasizing the group’s meetings must be open to the public. The suit claims DOGE lacks federal employee representation, with applications from two plaintiffs to join the committee ignored.
The lawsuit seeks to block DOGE operations until FACA compliance is ensured. However, Sam Hammond, an economist, argues DOGE is exempt, calling it a “branding exercise.”
