The Department of Education announced Friday it is scrapping former President Biden’s 2024 Title IX changes, eliminating protections based on gender identity and sexual orientation and altering how sexual assault cases are handled on campuses.
In a letter to schools, the department confirmed it is reinstating the 2020 Trump-era Title IX rules. Acting Assistant Secretary for Civil Rights Craig Trainor called Biden’s policy “an unlawful abuse of regulatory power,” emphasizing the new administration’s commitment to protecting women’s rights in school facilities and activities.
The revised rules define sex as “the objective, immutable characteristic of being born male or female.” Supporters say the 2020 rules strengthen due process in sexual assault investigations, while critics argue they make it harder for survivors to seek justice.
Biden’s regulations were previously challenged in court, with lawsuits in over 25 states and a Kentucky judge ruling them unconstitutional earlier this year.
