The Department of Justice said Tuesday that if Kilmar Abrego Garcia, a Maryland resident mistakenly deported to El Salvador, is returned to the U.S., he will be detained and removed again — unless deported to a third country or his protected status is revoked.
This comes after the Supreme Court ordered the Trump administration to “facilitate” his return following the erroneous deportation. Despite acknowledging an “administrative error,” the administration has not detailed any steps to secure his release from a high-security Salvadoran prison.
U.S. District Judge Paula Xinis demanded the DOJ provide documentation and updates, saying the court could consider holding officials in contempt if the situation isn’t resolved soon. “If everyone is operating in good faith, this will get done in two weeks,” she said.
El Salvador’s President Nayib Bukele has refused to return Abrego Garcia or release him. The DOJ’s filing indicates the administration may move to revoke his status and deport him again even if he returns.
