The Department of Justice has filed new charges against several January 6 defendants, even as President-elect Donald Trump plans to halt these prosecutions upon taking office. Trump has called the cases “political persecution” and pledged clemency for many involved.

Recent DOJ actions have focused on serious felonies. Two Florida men were arrested for using a metal Trump sign as a weapon against police, and a Virginia man was charged with assaulting an officer. Another defendant from California faces charges for wrestling a bike rack from police, while a case unsealed last week accuses Jeffrey Snyder of using a taser and bear spray during the riot.

Prosecutors have charged over 1,500 individuals since the Capitol attack, though many misdemeanor cases appear to be on hold. Reports suggest internal guidance has shifted focus to the most egregious cases, with federal authorities reluctant to pursue minor offenses after Trump’s election win.

Defendants have increasingly sought court delays, anticipating pardons or case dismissals under Trump’s administration. Attorney Bill Shipley criticized the DOJ for continuing prosecutions, arguing they waste resources and burden defendants with legal costs for cases unlikely to proceed under the incoming administration.
