The Department of Justice acknowledged Monday that Kilmar Armando Abrego Garcia, a Salvadoran national legally residing in Maryland, was mistakenly deported to El Salvador due to an administrative error.
Court filings show that Abrego Garcia, who had “withholding from removal” status because of potential harm in El Salvador, was detained on March 12, transferred to Texas, and deported on March 15 despite ICE being aware of his protected status.
His wife, a U.S. citizen, identified him in media photos showing detainees entering El Salvador’s Center for Terrorism Confinement. She is suing the Trump administration to compel the federal government to seek his return.
DOJ attorneys argue the U.S. cannot force El Salvador to release him and are asking a judge to reject the petition. Vice President JD Vance defended the deportation online, labeling Abrego Garcia an MS-13 gang member—despite no gang-related convictions.
The case adds to mounting legal scrutiny of Trump’s deportation efforts, including other court challenges over the targeting of foreign students and alleged gang members.
