Former President Joe Biden granted 4,245 acts of clemency during his four-year term, surpassing all other presidents since the 20th century, according to Pew Research Center. This number exceeds Franklin D. Roosevelt’s 3,796 clemency acts over 12 years.

Biden’s clemency included 80 pardons and 4,165 commutations. He issued “preemptive pardons” to figures like Dr. Anthony Fauci, Gen. Mark Milley, and his family members, aiming to protect them from potential future prosecutions. He also commuted the sentences of nearly all federal death row inmates.

His clemency record contrasts with recent presidents, as he granted 29% of requests received—the highest since Richard Nixon. Notably, 96% of his clemency actions occurred in his final months in office, with 2,490 commutations issued on Jan. 17, 2025, alone.

Biden’s use of clemency, particularly pardoning family and officials, has sparked controversy, adding to past debates over presidential clemency powers.
